Salary during forced vacation

On March 1, 2018, a meeting of the Crisis Committee under the Ministry of Energy and Coal was held, based on the results of which a protocol was drawn up and a number of decisions were made, including those concerning the suspension of educational institutions.

In particular, the protocol states that the Ministry of Energy and Coal Industry has decided to issue a crisis situation at the level of the emergency situation in the period from March 2 to March 6, 2018 (inclusive). In this regard, the protocol records a number of decisions of the Crisis Committee, including those concerning the work of educational institutions.

“To the heads of regional state administrations and the head of the Kyiv City State Administration: to suspend the work of preschool institutions, schools and higher educational institutions for the period of crisis situation of the emergency situation,” the protocol reads.

The full text of the protocol is posted on the websites of the Ministry of Energy and Coal Industry and the Ministry of Education and Science of Ukraine.

Taking into account the decision of the Crisis Committee, the Ministry of Education and Science of Ukraine recommends that all higher education institutions and all other educational institutions in the sphere of local government management be suspended from March 2 to 7, inclusive.

In the event that the heads of educational institutions and local self-government bodies make decisions on the suspension of the work of the relevant educational institutions, the salaries of the employees of these institutions shall be retained. In accordance with paragraph 77 of the Instruction on the procedure for calculating the salaries of educators, approved by the order of the Ministry of Education of Ukraine dated April 15, 1993 No. 102, in the case when on certain days classes are not held for reasons beyond the teacher’s control, his work is paid wages set for pricing, provided that the teacher (lecturer) performs other organizational and pedagogical work.

If there is no such work, downtime is paid in the manner and amounts specified in Article 113 of the Labor Code of Ukraine.

According to this article, downtime through no fault of the employee is paid at the rate of not less than two-thirds of the tariff rate set by the employee category (salary).

At the same time, paragraph 8.3.3 of the Sectoral Agreement between the Ministry of Education and Science of Ukraine and the Central Committee of the Trade Union of Education and Science of Ukraine for 2016-2020, registered with the Ministry of Social Policy of Ukraine on December 15, 2016 for No. 31, the parties recommend and educational institutions, to ensure the payment of downtime to employees, including non-teachers, through no fault of their own in the amount of the average salary, but not less than the tariff rate (salary); remuneration of teachers, educators, including educators of extended day groups, music teachers, teachers, other pedagogical staff of educational institutions in cases when on certain days (months) classes are not held for reasons beyond their control (epidemics, weather conditions, etc. ), at the rate of the salary established at tariffing, with observance thus of conditions of the current legislation.

Pursuant to clause 1.4 of the Agreement, the provisions of the Agreement apply directly and apply to employees of educational institutions and students who are within the scope of the parties to the Agreement, and are mandatory for inclusion in collective agreements, lower-level agreements.

Therefore, during the forced downtime, not through the fault of employees, they should keep the average salary, but not less than the salary.
